Terms of Service & Legal Disclaimers

1. Acceptance of Terms

By accessing or using ndisgoal.ai (including the Funding Forecaster, Compliant Goal Generator, I-CAN Simulator, AI voice calls, or any other feature), you agree to these Terms. If you do not agree, do not use the Service.

2. Important Disclaimers — Please Read Carefully

2.1 This is NOT an official NDIS assessment

The I-CAN Simulator, goal generator, and any scoring or predictions are simulations only. They are not a substitute for an official NDIA support needs assessment conducted by a qualified and accredited assessor. Results are indicative and may differ significantly from any official NDIA or I-CAN outcome.

2.2 Not financial, legal, medical or clinical advice

ndisgoal.ai provides general information and assistive tools only. It does not constitute financial, legal, medical, clinical, or compliance advice. You must obtain independent professional advice before making any decisions about NDIS plans, funding, or participant care.

2.3 No guarantee of funding, compliance or registration

We make no representation or warranty that use of the Service will:

• Prevent funding cuts
• Guarantee approval of goals or plans
• Ensure successful registration on or after 1 July 2026
• Result in any specific compliance outcome

Any compliance-related language on the site (e.g. “aligned to NDIS standards”, “designed to help prepare evidence for compliance”) means the tool is designed to assist you in preparing evidence. It does not guarantee that the NDIA, NDIS Commission or any auditor will accept the outputs.

2.4 AI limitations

Outputs are generated by artificial intelligence and may contain errors, inaccuracies or hallucinations. You must review, verify and take full responsibility for all content generated.

3. NDIS Commission AI Position

We acknowledge the NDIS Quality and Safeguards Commission's February 2026 position on AI. We do not send identifiable personal participant information to third-party AI models without explicit consent. All processing occurs on Australian-hosted infrastructure (Sydney). Human oversight is always required.

4. User Obligations

You agree that:

• You will not rely solely on the Service for any official submission to the NDIA
• You will apply appropriate clinical or professional judgement
• You will not represent the outputs as official I-CAN assessments or NDIA-approved documents
• You are responsible for obtaining valid consent from participants before uploading data or initiating AI calls

5. Limitation of Liability

To the maximum extent permitted by law, ndisgoal.ai, its founders, directors, employees and contractors are not liable for any loss, damage, cost or expense (including loss of funding, deregistration, fines, or legal costs) arising from your use of the Service, including but not limited to reliance on generated goals, forecasts, reports or simulations.

6. Indemnity

You indemnify ndisgoal.ai against any claim, loss or liability arising from your breach of these Terms or misuse of the Service.

7. Privacy & Data

See our Privacy Policy. Participant data is handled in accordance with the Privacy Act 1988 (Cth) and NDIS Practice Standards. Voice call recordings and analysis are stored in Australia.

8. Changes to the Service

We may update the Service, including simulation rules, at any time to reflect NDIS rule changes. Continued use after changes constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
